A divided Supreme Court of Canada decided in the City of Greater Sudbury case that project owners have “employer” obligations under the Occupational Health and Safety Act even when the work is contracted out to a “constructor”. This represents a dramatic change from the traditional “hands off” approach to health and safety that owners were required to take when hiring general contractors. Hear from the team at Construct Legal and the lawyers from Stringer LLP who argued the City of Greater Sudbury case at the Supreme Court about the impact of this key decision.
